Litigation is the traditional adversarial process in a court of law, involving parties with a dispute before a judge and often a jury.  It is commonly seen as traditional form of American dispute resolution, where a neutral decision maker is charged with resolving a contest between opposing parties over legal or factual issues, or a mixture of the two.
