rr_ne_coveredbridgeMediation is an alternative resolution mechanism to the traditional court proceedings.  It is a form of Alternative Dispute Resolution (ADR) and is often referred to as “facilitation”.  Mediation is either commenced voluntarily, with or without a pending case, or court ordered in a pending case.  Unlike arbitration (another form of ADR), mediation is non-binding and is dependent upon the willingness and ability of the parties and the mediator for a successful resolution.  Mediation has become more popular as a way of resolving disputes especially considering the uncertainty and cost of litigation.
